Support passage of legislation (S. 700 and HR 1747) to reduce the number of years farm and ranch equipment is depreciated over from 7 years to 5 years. Belong to an industry coalition that opposes changes by IRS in the LIFO method of inventory accounting for tax purposes and is seeking an extension of bonus depreciation into 2012-13.. In addition, involved with a service provider's effots to recognize a "tool reimbursement" program for technicians by the IRS for tools purchased by technicians.
Also concentrated on supporting a version of the estate tax issue. Our policy is to see an estate tax law that would support a $5 million dollar exemption (indexed for inflation) at a maximum tax rate of 35%.
Supported repeal of the 3% income tax withholding requirements when payments are made to equipment dealers and other businesses by governmental entities for goods or services after December 31, 2011 as required in the Tax Increase Prevention and Reconciliation Act of 2005.
Supported changes in IRS Code Section 263A enacted as a part of the Tax Reform Act of 1986 requiring taxpayers to capitalize direct and indirect costs properly allocable to certain real property and tangible personal property produced by the taxpayer and the real property and certain personal property that is acquired by the taxpayer for resale. Section 263A applies when a business has more than $10 million in sales for the year. The section is receiving renewed attention from the IRS as more and more businesses are exceeding the $10 million sales threshold. The IRS has not changed the required sales level since the original enactment in 1986. We supported a review by Congress of the existing threshold and recommend a new threshold of at least $50 million dollars as a way to exempt smaller business from this unnecessary burden and tax calculation.
Monitoring the progress of the Main Street Fairness Act (S. 1452 and H.R. 2701) that streamlines the collection of state's sales taxes and collections.

Opposed to Card Check legislation in the past and continue to oppose similar legislation and regulations that adversly affect our dealer members. Continue to monitor the Federal Motor Carrier Safety Administration actions and regulations concerning an agriculture exemption from Hours of Service and the Guidence Document on the definition of Implements of Husbandry.
Belong to an industry coalition that opposes the EEOC's proposed guidance document on criminal background checks. Also monitoring the activities of the National Labor Relations board on their ruling requiring labor notice posters in the workplace dealing with union formations, emlpoyee notifications, etc.

Supporting passage of the 2012 Farm Bill. See additional details on the next page.
NAEDA supports a new farm bill (2012) which: provides for planting flexibility, provides a safety net for producers and considers extreme weather conditions and trade related issues, balances the needs of conservation and the needs of land used for production, considers trade issues, supports education and research efforts, provides for rural development activities to include agricultural credit, beginning farmer programs and value-added programs for a renewable bio-economy, and provides for educational programs to assist dealers to hire and retain quality employees in the agriculture and outdoor power equipment industries.
We are monitoring Congressional actions to the passage of H.R. 2112 by the House on June 16th. We are concerned as to how to protect the jurisdiction of the Agriculture Committees roll in the Farm Bill. H.R. 2112 makes appropriations to the U.S. Department of Agriculture, the Food and Drug Administration and related agencies. Our issue is the policy debate over farm safety net programsthey belong as a part of the legislative process for writing the 2012 farm bill. The belief is that the farm bill is constructed with considerable care and deliberation to serve as the overarching farm safety net policy for five years. Allowing the current farm bill to be decided during hasty yearly appropriations bills strips authority from the Agriculture Committees and moves the legislative process further from the thoughtful debate that crafts better policy.
During consideration of H.R. 2112, the House Appropriations Committee adopted amendments that would effectively amend the 2008 farm bill with detrimental results for farm safety net programs. H.R. 2112 also contains large reductions in many of the programs authorized and funded through the 2008 farm bill. Decisions on how much mandatory spending should be allocated to programs that benefit farmers, rural communities, researchers and others should be made by the authorizing committee, such as the Agriculture Committees on both the House and Senate.

NAEDA belongs to the SaveOurGPS Coalition asking that FCC rescind the ability of LightSquared to jeopardize the current GPS System. Coalition has sent letters to Congress, the White House and FCC on the issue. Some of our dealers have also sent letters to USDA.
