"The Small Business Paperwork Mandate Elimination Act" (H.R. 4/S. 18): Legislation to amend the Internal Revenue Code to repeal a provision included in the "Patient Protection and Affordable Care Act" that extends to corporations that are not tax-exempt (including farms, ranches and small businesses) the requirement to report payments of $600 or more. The organization supports repeal of the mandate because tax-related paperwork and compliance are already major expenses for agricultural operations and businesses.
"Death Tax Repeal Permanency Act of 2011" (H.R. 1259): A bill to permanently repeal federal estate taxes on the date of enactment, ensure stepped-up basis remains permanent and cap the lifetime gift exemption at $5 million. The organization supports full, permanent repeal of estate taxes and believes stepped-up basis must be maintained.

Grain Inspection, Packers and Stockyards Administration (GIPSA) proposed rulemaking: USDA-GIPSA, at the direction of Congress in the 2008 Farm Bill, is proposing to add/revise regulations in the Packers and Stockyards Act to clarify conditions for industry compliance, specifically aimed at meat packers, live poultry dealers and swine contractors. As an organization that represents beef, pork and poultry producers, we closely follow proposals that affect livestock marketing and prices received by farmers and ranchers.

Federal Dairy Programs: The organization is interested in proposals to reform federal dairy support programs such as the Dairy Product Price Support Program and the Milk Income Loss Contract Program and the system (Federal Milk Marketing Orders) through which milk is priced and marketed called the Federal Milk Marketing Orders.
Deregulation of Genetically Engineered Alfalfa: As part of the Final Environmental Impact Statement for genetically enginnered alfalfa, the U.S. Department of Agriculture was considering three alternatives. The organization supported full deregulation of genetically enginnered alfalfa because USDA had concluded the crop does not pose a plant pest risk.

"Reducing Regulatory Burdens Act of 2011" (H.R. 872): Legislation that would amend the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) and the Clean Water Act (CWA) to clarify that CWA permits are not needed when a pesticide is applied in accordance with the FIFRA-approved label. The organization supports the bill because requiring CWA permits is duplicative and costly for farmers.

"FAA Air Transportation Modernization and Safety Improvement Act (S. 223): The organization supported amendments to the Federal Aviation Administration reauthorization bill to repeal IRS Form 1099 reporting requirements (Amendment #9-Stabenow) and repeal the "Patient Protection and Affordable Care Act" signed into law in 2010 (Amendment #13-McConnell). Pending trade agreements with South Korea, Colombia and Panama: The organization supports the trade agreements because economic analyses estimate substantial gains in sales of U.S. agricultural commodities and products to the three countries once the agreements are fully implemented. The organization is urging Congress to approve them soon as implementing legislation is submitted by the president.

Reauthorization of the "Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU): Legislation that establishes surface transportation policies and authorizes projects for a multi-year period. Of particular interest to our organization are provisions in the federal highway bill applicable to farmers who haul their own commodities to market.

The organization supported amendments to prohibit the EPA from regulating greenhouse gases based on climate change considerations (No. 215 - McConnell), eliminate IRS Form 1099 reporting requirements (No. 161 - Johanns), repeal a (continued on next page)
new three-percent withholding tax (Brown of Massachusetts) and prohibit EPA from implementing numeric nutrient standards for Florida waters (Rubio of Florida). The organization opposed amendments (Numbers 220 & 249) to reduce and/or eliminate federal tax incentives for ethanol.

National Amibient Air Quality Standards (NAAQS) for Coarse Particulate Matter (PM10): In recent years the organization has commented on proposed changes in the NAAQS for PM10. Reducing the current standard will affect rural counties, and farming and ranching operations in those counties. The organization supported the Lugar-Conrad letter to the Environmental Protection Agency expressing concern about a more stringent standard.
Chesapeake Bay Total Maximum Daily Load: The Environmental Protection Agency has issued a Total Maximum Daily Load (TMDL) for nutrient loading from the six states in the Chesapeake Bay watershed. The organization is concerned about validity of the science used and the approach taken by EPA.
"Energy Tax Prevention Act of 2011" (H.R. 910 /S. 482): Legislation to prohibit EPA from regulating greenhouse gases under the federal Clean Air Act based on climate change considerations, and other purposes. The organization opposes the regulation of carbon dioxide and other greenhouse gases and the Clean Air Act due to the impacts it will have on energy prices and the potential implications (financial and regulatory) on farm and ranch families. The organization supported the McConnell amendment to S. 493, which contained the text of the "Energy Tax Prevention Act."
"Defending America's Affordable Energy and Jobs Act" (S. 228/H.R. 750): A bill prohibiting the Executive Branch from promulgating, implementing or enforcing regulations to control emissions of greenhouse gases based solely on climate change, and other purposes. The organization opposes the regulation of greenhouse gases under the Clean Air Act.
"Clean Water Protection Guidance": An EPA and Army Corps of Engineers guidance document that addresses how the federal government will determine the jurisdictional status of waters and implement the Supreme Court's decisions in SWANCC and Rapanos. The organization opposes efforts to expand the reach of the Clean Water Act to waters currently regulated by the states.

"Casting Light on EAJA Agency Records for Oversight Act of 2011" (S. 549): A bill directing the U.S. Attorney General to issue an online report to Congress and the public on the amount of attorney fees and other expenses awarded during the preceding fiscal year under the Equal Access to Justice Act (EAJA) and other purposes. The organization supports reform of the EAJA to provide greater transparency through online public disclosure.

Missouri River Authorized Purposes Study (MRAPS): The organization opposes MRAPS and supports efforts to eliminate federal funding. Our members believe navigation and flood control should remain the dominant purposes of the Missouri River reservoir system. A provision to defund the study was included in the continuing resolution to fund the government for the remainder of the 2011 fiscal year.
Missouri River mitigation projects: The organization closely monitors mitigation projects along the Missouri River because of potential implications on flood control and navigation. The Jameson Island mitigation project in particular has raised concerns among our members because of problems with a levee across the Missouri River resulting from a chute constructed by a federal agency.

"The Full-Year Continuing Appropriations Act of 2011 (H.R. 1): Legislation to fund the federal government through the end of the 2011 fiscal year (September 30). The organization took positions on amendments relevant to our member adopted policies. We supported amendments to prohibit or restrict funding for EPA initiatives concerning climate change and coarse particulate matter. The organization also supported amendments to defund the Missouri River Authorized Purposes Study and eliminate our nation's
financial support for the United Nations Intergovernmental Panel on Climate Change.
USDA Agriculture in the Classroom (AITC) program: The organization supports AITC as a means to enhance agricultural literacy in classrooms across the United States. We inquired about funding for the 2011 fiscal year.
FY 2012 Budget: The organization is closely monitoring discussions concerning the president's fiscal year 2012 budget and the budget proposal put forth by House Budget Commitee Chairman Paul Ryan. An area of interest is the U.S. Department of Agriculture's budget.
