Testified to the U.S. Environmental Protection Agency (EPA) on regulatory efforts to possibly tighten the standards for particulate matter (PM) or soot, ozone and NOX. Noted many counties are in the midst of implementing plans to comply with current PM standards and that "moving the goalposts in the middle of the game" would cause many counties to fall into non-attainment status, thereby risking federal highway funds. Also strongly objected to the use of "hot-spot" project level conformity analysis.

Opposed change to House Rules to repeal the guaranteed funding requirement for annual federal highway investment. Prior to the change, any member of the House could raise a point of order to block legislation that would reduce federal highway invesment from the levels set in a multi-year reauthorization bill. Removing the protection made transportation investments subject to attempts to reduce spending.

Along with a coalition of more than 500 environmental, health, industry and labor organization urged continued support for the Diesel Emissions Reduction Act (DERA) program which provides general fund money to the U.S. Environmental Protection Agency for grants to be used for voluntary retrofits on vehicles, including construction equipment. Urged Senate Interior Appropriations Subcommittee to provde $50 million for the program in FY 2012 and to support President Obama's FY 2012 Budget Request of
$305.5 million for state and local air quality grants.
