"Reducing Regulatory Burdens Act of 2011" (H.R. 872): Legislation that would amend the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) and the Clean Water Act (CWA) to clarify that CWA permits are not needed when a pesticide is applied in accordance with the FIFRA-approved label. The organization supports the bill because requiring CWA permits is duplicative and costly for farmers. (Continued).
The organization also supports S. 718 that clarifies that lawful application of pesticides under the FIFRA does not trigger regulatory requirements in other programs.

H.R. 3078, 3079, and 3080: Bills to implement the United States-Colombia Trade Promotion Agreement, United States-Panama Trade Promotion Agreement and United States-Korea Trade Agreement. The organization supported the trade agreements because economic analyses show substantial gains in sales of U.S. agricultural commodities and products to the three countries once the agreements are fully implemented. The organization also supported H.R. 2832 to extend trade adjustment assistance.

Reauthorization of the "Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users" (SAFETEA-LU): Legislation that establishes surface transportation policies and authorizes projects for a multi-year period. Of particular interest to our organization are provisions in the federal highway bill applicable to farmers who haul their own commodities to market. (Continued).
H.R. 3265: A bill to clarify the U.S. Department of Transportations interpretation of the Hours of Service provisions of federal law as they apply to agricultural producers transporting farm commodities. The organization supports the legislation because it provides greater clarity for farmers in complying with federal laws and regulations.

"Farm Dust Regulation Prevention Act of 2011" (H.R. 1633/S. 1528): Legislation that would temporarily prevent the EPA from changing the national ambient air quality standard (NAAQS) for course particulate matter for one year. The bill would also exempt "nuisance dust" from regulation, unless nuisance dust was found to cause serious adverse health effects, and the benefits of regulation exceeded the costs. The organization supports H.R. 1633 and S. 1528.

Oil Spill Prevention, Control, and Countermeasures (SPCC) Rule: A regulation enforced by the EPA concerning above- and belowground storage of oil, fuel, etc. Facilities with certain quantities of oil/fuel storage must complete and implement a spill control plan to use in the event an emergency would occur. It is of interest to the organization because farms and ranches often have fuel storage areas.

FY 2012 Energy and Water Appropriations Bill: The legislation provides funding for various agencies and programs under the Department of Energy, Army Corps of Engineers, Bureau of Reclamation, Nuclear Regulatory Commission, and various regional water and power authorities. The organization supported two amendments to the bill: one to continue the funding prohibition for the Missouri River Authorized Purposes Study (MRAPS) and another to defund the Missouri River Ecosystem Restoration (continued)
Plan (MRERP) study. The organization opposes MRAPS and MRERP and supports efforts to eliminate federal funding. Our members believe navigation and flood control should remain the dominant purposes of the Missouri River reservoir system.
FY 2012 Interior, Environment and Related Agencies Appropriations Bill: Legislation to fund the Department of Interior, EPA, and other related federal agencies. The organization took positions on several amendments regarding issues of concern to our members. The organization supported language in the underlying bill pertaining to Clean Water Act guidance, greenhouse gases and pesticide permitting.
The Consolidated and Further Continuing Appropriations Act (H.R. 2112): An omnibus package containing the Fiscal Year 2012 Agriculture, Commerce/Justice/Science and Transportation/Housing and Urban Development Appropriations Bills. The organization was interested in FY 2012 funding levels for farm, conservation, rural development, food safety and other programs administered by the U.S. Department of Agriculture. The organization opposed amendments that would have altered the farm program safety net ahead of its reauthorization and supported an amendment to provide additional funding for programs to help farmers recover their land after natural disasters strike. The organization was also interested in provisions pertaining to horse processing and a rulemaking from the Grain Inspection Packers and Stockyards Administration.
FY 2012 Final Consolidated Appropriations Bill: A package of three bills containing funding for federal agencies under nine Appropriations bills, including Defense, Energy and Water, Financial Services, Homeland Security, Interior/Environment, Labor/Health and Human Services/Education, the Legislative Branch, Military Construction/Veterans Affairs, and State/Foreign Operations. The package also contained a bill (H.R. 3672) that provided funding for disaster aid and recovery assistance and a bill (H. Con. Res. 94) containing offsets for the disaster funding. The organization was interested in provisions contained in the Energy and Water and Interior Appropriations bills related to the Missouri River, Clean Water Act, greenhouse gases and other issues. The organization supported additional funding for the repair of levees and other infrastructure damaged by the flood events of 2011.
Farm Bill Budget Negotiations: The organization made agriculture spending reduction/savings recommendations to the Senate and House Agriculture Committees to consider as members developed a proposal to submit to the Joint Select Committee on Deficit Reduction. The organization also developed a new farm program proposal, the Strategic Risk Reduction Program, that was shared with both committees since an effort was underway to write a new farm bill to include in a deficit reduction package. The organization inquired about the status of the Agriculture in the Classroom program as part of the farm bill discussions.

"Dairy Security Act of 2011" (H.R. 3062): A bill to repeal the existing Dairy Product Price Support, Milk Income Loss Contract, export incentive programs and replace them with producer margin protection and dairy market stabilization programs. The bill would also reform the Federal Milk Marketing Orders. The organization supports the bill. (Continued).
Reducing the Deficit through Eliminating Agriculture Direct Payment Subsidies (REAPS) Act H.R. 2487: Legislation to amend the Food, Conservation and Energy Act of 2008 to terminate direct payments for covered commodities and peanuts and change the Food Security Act of 1985 to limit Average Crop Revenue Election and counter-cyclical payments to growers of program commodities. The organization opposes the bill. We believe changes in the current farm program safety net should be made when the farm bill in its entirety is reauthorized.
Animal Disease Traceability: The organization submitted comments to USDAs Animal and Plant Health Inspection Service (APHIS) concerning the proposed rule entitled Traceability for Livestock Moving Interstate and shared the comment letter with the Missouri Congressional delegation. The organization supports a voluntary program that will enhance animal disease control and eradication capabilities.

LightSquared's broadband deployment plan: Telecommunications company LightSquared has a proposal pending before the Federal Communications Commission to operate high-powered cellular base stations for broadband deployment. The organization is concerned about the interference with Global Positioning System (GPS) devices and conveyed member concerns to the FCC and to the Missouri Congressional delegation.

Response to natural disasters: The organization was in contact with members of the Missouri Congressional delegation and federal officials regarding flooding that occurred along the Missouri and Mississippi Rivers and other natural disasters such as the flash drought in areas of the state in July and August. (Continued).
Discussions pertained to damage assessments, recovery needs, and funding for programs like the Emergency Conservation Program, Emergency Watershed Program, and Livestock Forage and Indemnity Programs, which are administered by the U.S. Department of Agriculture.

The Tax Hike Prevention and Business Certainty Act (S. 1647 and H.R. 3091): Legislation that would permanently extend the 15 percent capital gains tax rate. Under current law the 15 percent rate will increase to 20 percent in 2013. The organization supports S. 1647/H.R. 3091. Capital gains taxes have a significant impact on farming and ranching because production agriculture requires large investments in land and buildings that are held for long periods of time. (Continued).
H.R. 674/S. 1726: Legislation to amend the Internal Revenue Code of 1986 to repeal the three percent withholding on certain payments made to vendors by government entities beginning in 2013. The organization opposed the tax because it would have applied to many U.S. Department of Agriculture payments

The Superfund Common Sense Act (S. 1729/H.R. 2997): Legislation to clarify that animal manure is not subject to liability or regulation under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) or the Environmental Protection and Community Right-to-Know Act (EPCRA). The organization supports amending the two laws to make this clarification. (Continued).
We believe Congress did not intend for CERCLA and EPCRA to apply to manure because the law clearly addresses the normal application of chemical fertilizers containing the same constituents as manure.

U.S. Department of Labor (DOL) Notice of Proposed Rulemaking (NPRM) entitled Child Labor Regulations, Orders and Statements of Interpretation; Child Labor ViolationsCivil Money Penalties: In September the DOL issued a NPRM that is of concern to the organization because of the potential impacts on farm and ranch families and high school agricultural education programs. (Continued).
The organization worked with lawmakers to ask for an extension of the comment period. The organization also urged representatives to cosign Rep. Rehbergs comment letter and senators to cosign the Moran-Nelson comment letter.

Ammonium Nitrate Security Program: The Department of Homeland Security issued a Notice of Proposed Rulemaking detailing the mechanics and implementation of the Ammonium Nitrate Security Program. Ammonium Nitrate is a widely used nitrogen fertilizer in Missouri, particularly on pasture land. The organization submitted comments explaining our members concerns with the program and shared the comment letter with the Missouri Congressional delegation.

Post Office Closings: The organization sent a letter to the Postal Regulatory Commission concerning the U.S. Postal Services examination of 3,653 postal offices for possible closure or consolidation. Our member-adopted policy supports five-day per week delivery if it would prevent closing small-volume offices or increasing postal rates. The Missouri Congressional delegation received a copy of the letter.

Stream Bank Erosion: The erosion of stream banks is a growing concern among Missouri landowners, but they are restricted in implementing practices to slow or stop soil loss due to policies of the Army Corps of Engineers and other federal agencies. The organization is asking the Corps, U.S. Fish and Wildlife Service and Environmental Protection Agency to work with state regulatory officials to allow landowners the flexibility to manage stream bank erosion without a site-specific permit. (Continued).
H.R. 2942: Legislation that would direct the Chief of the Army Corps of Engineers to revise the Missouri River Mainstem Reservoir System Master Water Control Manual to ensure greater storage capacity to prevent serious downstream flooding. The bill was introduced in response to the massive flooding that occurred along the Missouri River in 2011. The organization supports the bill.
